Phil's Instant Offer Terms & Conditions

What is Phil’s Instant Offer?
Phil’s Instant Offer is an invitation by Phil Buys Cars to you for you to sell your vehicle to us. If you qualify as a seller and meet certain conditions (like passing a vehicle inspection – see below) we will invite you to sell your vehicle to us.
​
A purchase agreement to sell your car to us will be issued and, until that agreement is signed, there is no obligation for you to sell, or for Phil Buys Cars to buy, your vehicle.
Seller qualification for the use of Phil’s Instant Offer program
In order to be qualified to sell a vehicle using Phil’s Instant Offer program (Program), the seller must:

be 18 years or older; and
-
be the registered owner of the vehicle being sold or an authorised representative of the owner.
A seller may not be considered a qualified seller if they:

hold a motor vehicle dealer license or are required to hold a motor vehicle dealer license;

are not private sellers. An example of a person who is not a private seller is a person who is in the business of renting or selling vehicles or using vehicles for commercial purposes ;

are selling a vehicle that in Phil Buys Cars reasonable assessment does not qualify for the Program. This may include vehicles where insufficient pricing data is available to Phil Buys Cars to make an Instant Offer or where we are unable to reasonably predict the cost of certain reconditioning works.
Vehicle qualification for Phil’s Instant Offer program
In order for a vehicle to be qualified for sale using Phil’s Instant Offer program:

The vehicle must be less than 12 years of age and 200,000km.

The vehicle must be complied in and located in Australia.

The vehicle must not have been used at any time for a commercial or business use.

At the time of transfer, the vehicle must be free of any encumbrance.

The vehicle must not be a repairable or repaired written off vehicle.
Vehicle Condition

Upon physical inspection appointment, your vehicle’s condition will be inspected and compared to the information regarding the condition of the vehicle provided by you during the online offer process. Where the vehicle’s condition does not match the information provided, your offer will be adjusted accordingly.
Vehicle Specification Errors

From time to time, due to errors or insufficient data in 3rd party registration data and vehicle specification data, errors may occur in matching your vehicle registration to your actual vehicle specification, and therefore incorrect offers may be presented during the online offer process.

During the inspection appointment, these details will be validated using your vehicle’s build plate details, compliance plate details, and other compliance checks.

Your vehicle specification and offer may be corrected to reflect the validated details determined during the physical inspection, where applicable.
Phil’s Instant Offer Validity Period

Only one Phil’s Instant Offer is valid at any point in time.

A new Phil’s Instant Offer will overwrite/make invalid an existing Phil’s Instant Offer.

A Phil’s Instant Offer is valid for the period of time specified on that offer. Where no expiry date is specified, Phil’s Instant Offer will automatically expire on the 7th business day after the date of the offer.
Payment & Transfer

Upon an accepted Phil’s Instant Offer, best efforts will be made for next business day payment to the seller, however some factors may impact our ability to achieve this, and payment will occur as soon as practically possible.

Finance payouts require a payout letter from your finance company in order to initiate settlement and payment.
Our Rights

Phil Buys Cars reserves the right to physically sight and inspect the vehicle to confirm Phil’s Instant Offer.

Phil Buys Cars reserves the right to road test vehicles to confirm Phil’s Instant Offer.

Where a vehicle is misdescribed (including but not limited to make, model, year, specification, kms, damage, vehicle condition, etc.), or Phil’s Instant Offer is unable to capture details relevant to accurately value the vehicle, Phil Buys Cars reserves the right to revalue the vehicle or refuse purchase.

Phil Buys Cars has minimum acceptable conditions for vehicles that receive an offer to purchase, factors influencing this include but are not limited to incomplete service history & records, exterior damage, interior damage, structural damage, warning lights, major mechanical issues, oil leaks, modifications negatively impacting roadworthiness or vehicle value.

Phil Buys Cars reserves the right, at its sole discretion not to purchase or make an offer to purchase the vehicle and its decision is final, regardless of whether a Phil’s Instant Offer has been made.
Privacy

If you submit a request for a Phil’s Instant Offer, you consent to us using the information provided to use third party data to identify your vehicle.

If you submit a request for a Phil’s Instant Offer, you consent to us following you up, if an inspection appointment has not been made.

By using Phil’s Instant Offer program, you consent to receiving correspondence (including electronic correspondence) from us regarding your use of the Program. This correspondence forms part of the Phil's Instant Offer and is necessary for the management of your offer. If you do not wish to receive this correspondence, please do not use the Program.
